Wisconsin’s Good Samaritan Law

I’m worried about carrying Narcan because I use drugs or someone in my household does. Won’t I get in trouble?

Don’t worry. It is safe for you to help someone who is experiencing an overdose.

Most states, including Wisconsin, have a Good Samaritan Law. These laws protect overdosing people and anyone assisting them in an emergency from arrest, charges, or a combination of these. Similarly, you will not get into legal trouble for carrying Narcan. You will not be held responsible for any outcomes resulting from giving someone Narcan.

“Wisconsin laws state that any person may possess a medication to reverse an opioid overdose, such as Narcan. They may also administer or give it. Under the Wisconsin Good Samaritan Law, you cannot be held civilly liable for a good faith effort to provide assistance in a life-threatening situation. State law also provides limited immunity from criminal prosecution for certain amounts of controlled substance possession and the possession of drug paraphernalia for a person who aids another person who experienced an overdose from a controlled substance.”
